The time has come to renew the designation of MRED as the DMCA takedown agent for our customers. Under new U.S. Copyright Office regulations, MRED is not readily able to do this again on your behalf as we did in 2015. Instead, each of you (or your company) must complete a separate registration online and pay a small ($6) fee.

It is to your benefit to file your electronic designation of agent as soon as possible so that MRED may continue to offer you the administrative benefit of a shared takedown agent.

To take advantage of this benefit, please file a designation of agent using the new electronic filing system.

  • Create a registration account using the following link:
  • Once your account has been activated, log in and click "Add Service Provider"
  • Add your business's name in the Service Provider information, as well as the address, telephone number, and email
  • If your business has multiple websites, operates under any aliases, or is know to the public by any other name, add those names to the "Alternate names" field
  • For your designated agent, use the below information to designate MRED as your DMCA takedown agent:

Midwest Real Estate Data (MRED) complies with the provisions of the Digital Millennium Copyright Act (DMCA). If you have a concern regarding the use of copyrighted material on any MRED web site, please contact the agent designated to respond to reports alleging copyright infringement.

Designated Agent:

The designated agent for MRED to receive notification of claimed infringement under Title II of the DMCA is:

The DMCA specifies that all infringement claims must be in writing (either electronic mail or paper letter) and must include the following:


  1. A physical or electronic signature of the copyright holder or a person authorized to act on his or her behalf;
  2. A description of the copyrighted work claimed to have been infringed and multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. A description of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit the service provider to locate the material;
  4. Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.


Q: Why should we bother with this? What is the benefit to MRED doing this?

A: The best way to explain this the DMCA is by an example. Should any MRED customer put a picture in the MLS that he or she doesn't own for copyright purposes, that can cause a problem for any other MRED customer who has an MLS search on their website. By registering and naming MRED as the designated agent in the DMCA Notice on the site, should someone see a picture in the MLS search that they believe they own and did not give permission to use, they'll simply notify us and we'll take it down pending resolution between the parties, without any liability/damages incurred (due to the "safe harbor"). MRED is doing this because we want to be notified if there is a problem photo or something else in the system, so we can address it.

Q: Can a brokerage register on behalf of all of its associates?

A: Yes, a brokerage can register on behalf of its associates. If the brokerage doesn't, each individual associate would have to purchase it separately (at $6 a piece versus one $6 charge for the entire brokerage) if they wanted to take advantage of the DMCA safe harbor protection. NOTE: when you proceed through the registration, it does request the URLs for all sites you are protecting. So, make sure you gather the URLs from your associates before you proceed to the registration so you are prepared to include them.

Q: What if I've already registered but want to include URLs that weren't included with the first registration?

A: You can modify any registration to include additional URLs, or change any other information for that matter. The charge? Just another $6 (not $6 per URL).
